Possession of Marijuana for Sale in California
It is unlawful in California to possess marijuana with the intent to sell it unless you have a license. This crime is generally a misdemeanor carrying the following penalties:
- Up to six months in jail
- A fine of up to $500
You can be charged with a felony for this offense under the following circumstances:
- You have previous marijuana misdemeanors
- You have been convicted of previous violent crimes
- You sold or attempted to sell to minors under 18
Felony penalties in these cases include jail time of 16 months, two years, or three years. Drug diversion programs are not available to defendants in felony cases.
