Domestic Violence Charges

A 911 call by a neighbor or by a spouse in the heat of an argument can have you led away in handcuffs. Domestic violence can range from a shouting or shoving match to domestic assault and battery resulting in serious injury. It can involve an altercation with a spouse or live-in partner, a boyfriend or girlfriend, a parent, sibling, child, or any family member.

Prosecutors will earnestly pursue the case even if the victim declines to press charges. Defendants are removed from the home and often allowed no contact with the alleged victim or children. If domestic battery is charged as a felony, you may be facing a year or more in prison. Even a misdemeanor charge can carry up to a year in jail. Violation of a restraining order is also a serious criminal offense.

Domestic violence accusations are frequently leveled during a divorce or break-up to gain advantage in divorce and custody proceedings, or simply out of spite. I look at police reports and witness statements, prior offenses, and whether the alleged victim has made similar allegations in the past.

These cases usually do not go to trial. I am a skilled negotiator who will make every attempt to get charges reduced or dismissed. In many cases, we can settle with the district attorney for enrollment in a batterer's program, fines, community service, and/or probation.

Child Abuse Charges

If you are accused of child endangerment (speeding or drinking with a child in the car, leaving young children home alone), or physical abuse of a child (striking, cruel punishment), you face the double consequences of criminal charges and loss of custody/visitation. Child Protective Services may remove the child from the home pending the outcome of the case.

We can work with CPS and the court to gain supervised visitation, and seek reduced charges to avoid or minimize jail or prison time.
